Liability

Micro Star 2000 Inc. assumes no liability for consequential damages of any kind. Since the use of this equipment is beyond Micro Star 2000,s control, the buyer by acceptance of this equipment will assume all liability for its use or misuse. A defect in any part of a machine or system shall not, when such part is capable of being repaired or renewed, operate to condemn such machine or system. Customer modifications of equipment or software may void entire warranty. This warranty is in lieu of all other warranties, guarantees, obligations or liabilities expressed or implied by the seller or its representatives and by statue of law.

The Seller shall not be liable for loss or damage due to delay in manufacture or delivery resulting from any causes beyond the seller's reasonable control, including but not limited to compliance with any regulations, orders or instructions of any federal, provincial or municipal government or any department or agency thereof, force majeure, acts or omissions of purchaser, acts of civil or military authorities, fires, strikes, factory shutdowns or alterations, embargoes, war riots, delays in transportation and inability due to causes beyond the sellers reasonable control to obtain necessary labour, manufacturing facilities or materials from the sellers usual sources and any delays resulting from such causes shall extend delivery dates correspondingly. In no event shall the seller be liable for consequential or specific damages or act due any causes.

Any stenographic or clerical errors appearing in the typed portion of any quotation may be corrected at any time by Micro Star 2000 Inc. The seller reserves the right to make changes in design and manufacture of any item covered by a quotation without incurring any obligations to install the same upon units manufactured for delivery to the buyer prior to such design changes under any contract resulting from an order based upon a quotation. The quotation shall become an agreement binding upon the seller when accepting in writing by the buyer and subsequently approved buy an authorized representative of the seller, and thereupon shall constitute the entire agreement between the parties pending credit approval. No representative of the seller is authorized to modify these terms and conditions unless modification is contained in written instrument signed by a company officer.
